Privacy Policy

Hard Hat Industry Solutions (“Hard Hat,” “we,” “us,” or “our”) provides Red Rhino Electrical Estimating Software and operates hardhatis.com. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, start a trial, create or use an account, purchase or use Red Rhino, request support, or otherwise interact with us.

1. Who We Are and Scope of This Policy

Hard Hat Industry Solutions provides Red Rhino Electrical Estimating Software for electrical contractors and estimating teams and operates from Tustin, California. This Policy applies to hardhatis.com, Red Rhino account and login experiences controlled by Hard Hat, and Hard Hat-controlled trial, account, support, subscription, and service interactions that link to this Policy.

This Policy does not replace a customer agreement, order form, or other contract. It also does not govern a website or service controlled by another company, even if we link to it. Those services are governed by their own privacy notices.

2. Personal Information We Collect

The information we collect depends on how you interact with us. It may include information you provide, information generated when you use our website or services, and information received from organizations or service providers involved in a trial, account, purchase, support interaction, or referral. A category described below may not apply to every person.

3. Information You Provide to Us

You may provide information when you contact us, start a trial, create or administer an account, make a purchase, update billing information, request support, participate in training, or use Red Rhino. Depending on the interaction, this may include:

  • Contact details, such as name, business email address, work telephone number, optional mobile number, and the content of your message.
  • Business details, such as company name, business address, city, state, postal code, and how you heard about Red Rhino.
  • Trial and account details, such as registration information, username, password, account contacts, authorized users, and account-administration requests.
  • Purchase and billing details, such as the plan or number of licenses selected, transaction records, billing contact information, and information submitted to a payment or billing service. Payment-card handling is subject to the process used by the applicable payment and billing provider.
  • Communications, including contact-form messages, email, telephone conversations, support requests, training questions, and feedback.
  • Customer-submitted content, described in Section 6.

The current hardhatis.com contact form asks for name, email address, telephone number, and an optional message. The current hosted trial form asks for first and last name, email address, work telephone number, optional mobile number, company name, company address, city, state, postal code, and referral source.

4. Information Collected Automatically

When you visit hardhatis.com, open a hosted trial form, or use an account service, the applicable systems may automatically receive technical and usage information. Based on the current website and trial pathway, this may include:

  • the page or feature viewed and the date and time of the interaction;
  • referring-page, campaign, and landing-page information;
  • browser, device, operating-system, and network information generated by the request;
  • internet protocol address or related security and routing information;
  • page-view and interaction events used to understand website use;
  • login, session, form-security, and application activity used to operate and protect the services; and
  • cookie, local-storage, or similar identifiers used by the applicable website, analytics, security, or form service.

The hosted trial form currently contains fields and security components associated with time-zone and internet-protocol information, Google reCAPTCHA, and Keap form and website tracking. We do not use this description to claim that every listed item is collected in every interaction.

5. Information Received From Other Sources

We may receive information from a service provider that operates a trial, order, billing, analytics, security, or communication function; from a referral source identified through campaign or referral information; or from an organization that asks us to provision, administer, or support an authorized user. Information received from another source is handled for the purposes described in this Policy and subject to applicable agreements and law.

6. Customer Accounts and Customer-Submitted Content

Red Rhino allows business customers and their authorized users to enter information used in their estimating work. Depending on how a customer uses the software, this may include customer and project details, estimates, sections, products, assemblies, quantities, labor information, material pricing, costs, overhead, profit, recap information, proposal content, and related business records. This content may contain personal information if a customer or authorized user chooses to enter it.

Customers decide what information to enter and which authorized users may use their account. Hard Hat handles customer-submitted content to provide, secure, maintain, troubleshoot, and support Red Rhino; to follow instructions associated with the customer relationship; and for other purposes described in an applicable agreement or permitted by law. Customers are responsible for deciding what information to submit and for providing notices or obtaining permissions required for that information.

Separately, Hard Hat handles information about website visitors, trial participants, customer and billing contacts, authorized users, and support communications for its own sales, account administration, security, support, and operational purposes. Hard Hat’s legal role may vary according to the context and applicable law.

7. How We Use Personal Information

We use personal information as reasonably necessary to:

  • provide, operate, maintain, and administer hardhatis.com and Red Rhino;
  • create and manage trials, accounts, authorized users, licenses, subscriptions, and billing relationships;
  • process transactions and maintain related business records;
  • provide customer support, onboarding, and training;
  • send account, security, billing, support, and other transactional communications;
  • send marketing communications where permitted and manage communication preferences;
  • authenticate users, prevent misuse, troubleshoot problems, and protect the security and integrity of the services;
  • understand website use and improve our website content, support, and operations;
  • enforce agreements, resolve disputes, and establish, exercise, or defend legal claims; and
  • comply with legal obligations and respond to lawful requests.

8. Cookies, Analytics, and Similar Technologies

The production website currently uses Google Analytics, implemented through MonsterInsights, to help us understand website use. This can involve page-view and interaction information, referral and campaign information, and technical information generated by the visitor’s browser or device.

The current hosted trial form uses Keap or Infusionsoft form technology, Keap web-tracking components, and Google reCAPTCHA. Those components may use cookies or similar technologies to operate the form, reduce abuse, understand referrals, process the registration, and support internal sales follow-up.

The website may also use technologies that are necessary for WordPress administration, security, login, preferences, media, and basic site operation. Browser settings may allow you to block or delete some cookies, but doing so can affect functionality. If we introduce technology that requires consent or an additional privacy choice under applicable law, we will provide an appropriate control.

9. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:

  • hosting, analytics, form, customer-relationship-management, email, payment, billing, security, backup, support, and other service providers performing work for us;
  • the applicable customer, account contacts, and authorized users where needed to administer a business account;
  • professional advisers such as accountants, auditors, insurers, and legal advisers;
  • government authorities, courts, regulators, law enforcement, or other parties when required or permitted by law;
  • parties involved in an actual or proposed merger, financing, acquisition, reorganization, sale of assets, or similar business transaction; and
  • another recipient when you direct or authorize the disclosure.

We do not describe the use of a software plugin by itself as a disclosure to that plugin’s developer. Whether a provider receives personal information depends on the configured service and the information transmitted to it.

10. Service Providers and User-Directed Services

Hard Hat uses service providers and software to operate its website and business. Current verified services include website hosting, Google Analytics, and Keap or Infusionsoft-hosted trial forms and customer-relationship-management technology used to support internal sales follow-up. Other providers may support functions such as email delivery, security, backups, payments, billing, or customer support. The information available to a provider depends on the configured service and the applicable relationship. Payment information may be submitted through a provider-hosted checkout or payment service; we do not make a statement here about which provider stores or can view full payment-card details.

If you choose to follow a link, submit information through a provider-hosted page, or direct information to another service, that provider may handle information under its own privacy notice. The existence of an operational provider does not mean Red Rhino offers a customer-facing product integration with that provider.

11. Sale, Sharing, Targeted Advertising, and Privacy Signals

Hard Hat does not sell personal information for money and does not currently use personal information for cross-context behavioral advertising. We disclose information to service providers for the operational purposes described in this Policy, including website hosting, analytics, trial registration, customer-relationship management, security, communications, billing, and support. Some privacy laws use specialized definitions of “sell” and “share” that may apply differently from ordinary usage.

Because our current practices do not include using personal information for cross-context behavioral advertising, the website does not currently provide a separate targeted-advertising opt-out control. We do not claim that the website currently recognizes Global Privacy Control or another browser opt-out signal for an activity we do not presently conduct. If our practices change, we will update the website controls and this Policy as appropriate.

Our website does not currently respond to browser Do Not Track signals. Third parties that provide analytics, hosted forms, security, or embedded-content services may collect information about online activity over time and across different websites according to their technologies and privacy notices.

12. Marketing and Communication Choices

You may stop marketing email by using the unsubscribe method in the message or by contacting us through the method in Section 23. Even after a marketing opt-out, we may send non-marketing communications that are reasonably necessary for an account, transaction, billing matter, security notice, support request, or service relationship.

13. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the services, maintain business and transaction records, support account reactivation where applicable, comply with legal obligations, resolve disputes, enforce agreements, and protect the security and integrity of the services. Cancelling a Red Rhino account disables access but does not automatically delete account information or customer-submitted content. We currently retain that information after cancellation for operational, legal, security, backup, recordkeeping, and possible reactivation purposes.

The period may vary according to the type of information, the relationship, operational need, applicable legal requirements, and backup or security needs. Removal from an active system may not immediately remove limited copies maintained in backups, security records, or records that must be preserved for a legitimate legal or business purpose.

14. Data Security

We use safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for protecting account credentials and for notifying us if you believe an account or credential has been compromised.

15. Privacy Rights and How to Submit a Request

Depending on your location and applicable law, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information, or to object to or limit certain uses. These rights may be subject to exceptions.

To submit a request, use the contact method in Section 23 and clearly state that the request concerns privacy. Privacy requests are reviewed and routed to the appropriate person within Hard Hat. We may take reasonable steps to verify your identity, authority, and relationship to the information before acting. If you submit a request for another person, we may request evidence of authorization. If information is controlled by a Red Rhino business customer, we may direct you to that customer or coordinate with the customer as appropriate. We will respond as required by applicable law and may deny or limit a request where an applicable exception permits us to do so.

16. Additional Information for California Residents

California law may provide rights concerning categories and specific pieces of personal information, sources, purposes, disclosure recipients, correction, deletion, portability, certain sensitive-information uses, and opting out of a sale or sharing, together with a right not to receive discriminatory treatment for exercising an applicable right.

These rights apply only when the relevant law covers Hard Hat and the particular information or interaction. California residents may submit a privacy inquiry using Section 23. We will evaluate the request under applicable law and may take the verification steps described in Section 15.

17. International Users and Cross-Border Processing

Hard Hat operates from California and serves business customers in the United States and Canada. Information from Canadian customers may be transferred to and processed in the United States and in other places where an applicable service provider operates. Privacy laws in those places may differ from those in your location.

When personal information is processed in another country, it may be accessible to courts, law-enforcement agencies, or national-security authorities in that country under its laws.

Canadian residents may have rights under applicable federal or provincial privacy law to request access to or correction of personal information, withdraw consent where consent is the basis for processing and withdrawal is legally available, or challenge our handling of personal information. Submit a request or concern to the Privacy Coordinator using Section 23. These rights are subject to applicable exceptions and do not require us to delete information that we are permitted or required to retain.

18. Account Administrators and Authorized Users

If an organization provides or manages a Red Rhino account, its authorized account contacts may direct account administration and may be able to access account information and customer-submitted content as permitted by the account and configured permissions. Questions about an organization’s own handling of information should be directed to that organization. Authorized users should use Red Rhino only within the authority provided by the customer that controls the account.

19. Children’s Privacy

Red Rhino is a business service intended for electrical contractors and estimating teams and is not directed to children. We do not knowingly collect personal information from children under 13. If a parent or guardian believes a child provided personal information through a Hard Hat-controlled service, the parent or guardian may contact us using Section 23 so the matter can be reviewed and appropriate action taken.

20. Third-Party Websites and Services

Our website may link to websites, videos, maps, social networks, forms, billing pages, and other services that are not controlled by Hard Hat. We are not responsible for the privacy practices of those third parties. Review the privacy notice of the service you choose to use. A Red Rhino account service controlled by Hard Hat is part of the service scope even when it uses a separate Red Rhino-controlled subdomain.

We may disclose information in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to appropriate confidentiality and legal requirements. We may also preserve or disclose information as reasonably necessary to comply with law or lawful process, enforce agreements, protect rights or safety, investigate misuse, or defend a legal claim.

22. Changes to This Privacy Policy

We may update this Policy to reflect changes in our services, practices, providers, or legal obligations. We will post the updated Policy with a revised “Last Updated” date. If an additional notice is required by law for a material change, we will provide it through an appropriate method available for the affected relationship.
